Purpose

These are the general conditions governing access to, browsing of and use of the web portal (hereinafter, “Website”), and the responsibilities arising from the use of all its contents. In addition, CEDA, S.A may establish particular conditions governing access to and/or contracting of specific services offered to users of the Website. Such specific services shall be subject to their particular conditions, which may be accessed at the URL of that service.

Users and conditions of access

For these purposes, user shall mean the person who accesses, browses or uses the Website. Access to, browsing of and/or use of the CEDA, S.A Website implies the user’s full and unreserved acceptance, as well as the validity, of all the General Conditions set out in the latest updated version of this document. Consequently, the user must be aware of the importance of reading them each time they visit the Website. Access to and/or use of certain services offered to users on the Website may be subject to certain conditions which, depending on the case, replace, modify and/or supplement these Rules of use, and therefore the user must read and accept such conditions prior to accessing and/or using these services and contents. To access our services, you declare that you are of legal age and have the legal capacity to act in accordance with your national law.

The content of the website is provided for informational purposes regarding our products and services, as well as to manage all types of bookings at our facilities and, in general, so that the client can find on this website all the information relating to Anyos Park.

Conditions of use

The User undertakes to use the Website, its contents and services in accordance with current legislation and this Legal Notice. Likewise, the User undertakes not to use the Website or the services provided through it for purposes or effects that are unlawful or contrary to the content of this Legal Notice, harmful to the interests or rights of third parties, or that may in any way damage, disable or deteriorate the Website or its services, or prevent other Users from enjoying the Website normally. The User also expressly undertakes not to destroy, alter, disable or otherwise damage the data, programs or electronic documents and others found on this Website. The User undertakes not to obstruct other Users’ access to the access service by making mass use of the computer resources through which the Website owner provides the service, and not to carry out actions that damage, interrupt or generate errors in those systems. The User undertakes not to introduce programs, viruses, macros, applets, ActiveX controls or any other logical device or sequence of characters that cause or are likely to cause any kind of alteration in the computer systems of the Website owner or of third parties. Access to the Website by the User is free of charge; however, some of the services and contents offered by CEDA, S.A or third parties through the Website may be subject to prior contracting of the service or product and payment of an amount in the manner determined in the corresponding particular conditions, in which case the User will be provided with clear and accurate information on the price of the product or service and applicable taxes. If, in order to use and/or contract a service on the Website, the User must register, they shall be responsible for providing truthful and lawful information. If, as a result of registration, the User is given a password, they undertake to use it diligently and to keep the password secret in order to access those services. Consequently, the User is responsible for the proper safekeeping and confidentiality of any identifiers and/or passwords supplied to them by the Website, and undertakes not to transfer their use to third parties, whether temporarily or permanently, nor to allow access to them by unauthorised persons. These rights belong exclusively to CEDA, S.A or its licensors. All rights reserved. Internet users who access this website may view the information contained therein and make private downloads or reproductions on their computer system, provided that the reproduced elements are not subsequently transferred to third parties or installed on a server connected to the Internet or a local network. Without prejudice to the provisions of these Rules of use, the distribution, modification, transfer, public communication, reproduction or any other act of part or all of the information published on the Website is not permitted without prior authorisation from CEDA, S.A. The user must use the contents and information contained in the Website diligently, correctly and lawfully and, in particular, solely for personal and non-commercial use, provided that the content or any mention of sources, copyright and other identifying rights data of CEDA, S.A or third parties is not removed or modified, that is, respecting its original form. Any reproduction, copy, distribution or publication, of any kind, of the content of the information published on the Website without prior written authorisation from CEDA, S.A is prohibited. Right of exclusion

CEDA, S.A reserves the right to temporarily or permanently exclude users in any of the following cases: a) For breach of any of the General Conditions of use established in this document. a) For breach of laws, morality and public order. The exclusion of users shall not imply CEDA, S.A’s waiver of taking the corresponding legal actions or compensation to which it may be entitled by law.

Exclusion of guarantees and liability

CEDA, S.A does not guarantee the reliability, availability or continuity of the operation of its website or of the products or services made available to the user, and therefore excludes any liability for damages and/or losses of any nature that may be due to the lack of availability, reliability or continuity of its website or its services, although it will attempt to provide, as far as possible, technical assistance to the affected person. As indicated, CEDA, S.A does not guarantee permanent availability of access to the Website or to the services it offers, and is therefore especially exempt from liability for service deficiencies attributable to the server centre or connection networks and for damages that any computer virus or malicious program could cause. Safeguarding of the rules of use

If any of the stipulations of these Rules of use is declared null or inoperative, the remaining Conditions shall remain in force for the agreed terms. CEDA, S.A undertakes to replace the affected stipulation by one that comes as close as possible to the intention initially pursued by the parties.

Applicable law and competent jurisdiction

These Rules of use are governed by the Law of the Principality of Andorra. CEDA, S.A and the users, for the resolution of any controversy that may arise regarding their validity, execution, compliance or resolution, in whole or in part, submit, with express waiver of their own forum or any other that may correspond to them, to the jurisdiction of the Courts and Tribunals of the Principality of Andorra. This contract constitutes the complete and entire expression of the agreement between CEDA, S.A and the user, and replaces all previous pacts, commitments, statements or agreements, both written and oral, that may have previously existed between both parties.
